ALABAMA: Constitutional Presidential Candidate Files Suit

A Presidential Candidate Pulls An Obama

Constitution Party presidential candidate, Virgil Goode and Hugh McInnish, an Alabama resident and active GOP member, filed a recent Civil Action -CV-12-1053 in Alabama's Montgomery County Circuit Court requesting the Alabama Secretary of State Beth Chapman “verify president Barack Obama’s eligibility –and all of the candidates—to be placed on or remain on the November 6, 2012 general election ballot” according to a news release published by PRNewswire-USNewswire.

The news release goes onto state -

“In particular, the complaint alleges that there is prima facie evidence that both Obama's birth certificates are fraudulent, and that, under the Supreme Court interpretation, he does not qualify in any event as a "natural born citizen" eligible to be president.

The complaint alleges that under the Alabama and U.S. Constitutions the Alabama Secretary of State, having taken an oath to uphold both, must verify Mr. Obama's eligibility; otherwise a fraud could be committed on the American people and votes nullified in the state of Alabama.

The Complaint also refers to and incorporates evidence obtained by Sheriff Joe Arpaio and his investigator Mike Zullo, which confirm that the alleged long form birth certificate which was posted on the White House's website is fraudulent.

The Complaint demands that the Alabama Secretary of State require that all candidates For President wishing to be on the Alabama ballot produce their birth certificates.

Plaintiffs are being represented by two attorneys, Larry Klayman, founder of Judicial Watch and Freedom Watch, in his private capacity (See www.larryklayman.com), and by Dean Johnson of Huntsville. The attorneys have asked the court for expedited consideration of the Complaint and have submitted a Motion for Summary Judgment, given that the presidential election is only a month away.”

You may recall, Hugh McInnish filed a challenge months ago which was stricken due to the case being filed in the wrong jurisdiction. However, when the Order to Strike McInnish’s Petition for Writ Mandamus was issued, Alabama Supreme Court Justice Tom Parker stated in the Order -

"Mclnnish has attached certain documentation to his mandamus petition, which, if presented to the appropriate forum as part of a proper evidentiary presentation, would raise serious questions about the authenticity of both the "short form" and the "long form" birth certificates of President Barack Hussein Obama that have been made public."

Since receiving the Order in March 2012, McInnish set out to re file his Writ in the "appropriate forum" and to secure an attorney with constitutional experience. It looks like he has successfully achieved his goals--the recent filing of the Civil Action in the Circuit Court of Montgomery, Alabama and attaining Larry Klayman as attorney of record. As well, he picked up a new Plaintiff who has “standing” that being Virgil Goode.

Who is Virgil Goode?

Goode earned his law degree from the University of Virginia School of Law. He won a Virginia State Senate seat as an Independent in 1973 at the ripe young age of 27. Shortly after his win, he switched his party affiliation from Independent to Democrat. In 1996 he captured Virginia’s 5^th District seat for the U.S. Congress. In 2000 Goode switched back to being an Independent caucusing with Republicans and in 2002 ran on the Republican ticket. In 2008, after serving six terms in the U.S. House of Representatives he lost his seat to Democrat Tom Periello. Republican’s regained the seat in 2010.

Goode is the 2012 presidential candidate for the Constitution Party and has secured a slot on Alabama's presidential ballot running as an Independent (at the time of this posting we were unable to verify why he's listed as an Independent rather than a Constitution Party candidate). The Constitution Party is backing his run and serves as a legitimate political entity with a growing organization behind it.

Over the last six or more months, primary ballot challenges have been filed by numerous citizens in a majority of states focusing on Secretary's of State to remove Mr. Obama, in particular, from the ballot due to his inability to meet Article II eligibility. Many electors have focused on Article II qualifications with an emphasis on Mr. Obama's lack of "natural born Citizenship," others have leveled challenges using Sheriff Arpaio's investigative findings while some have incorporated both strategies. To date none have broken through the judicial firewall, but this Goode-McInnish Civil suit may very well succeed where others have not.

First, Goode has automatic standing to challenge all of the presidential candidates to verify their Article II qualifications to be on the Alabama general election ballot because he, as a candidate, will be harmed by having to run against constitutionally ineligible candidate(s). Goode-McInnish are simply excercising their rights and employing the same tactic Mr. Obama used when he challenged the petition signatures of then candidate Alice Palmer during his bid for her state senate seat in 1996.

Second, the Goode-McInnish suit is placing the burden of constitutional verification on Alabama's Secretary of State before the general election. We know that the Secretary's of State throughout the country simply rubber stamp the Republican and Democratic Party presidential/vice presidential nominees as the state legislatures require. Until this filing, no presidential candidate winning a spot on the general election ballot has issued a challenge to a Secretary of State demanding verification of his opponent(s) constitutional qualifications. You may recall back in 2008 Wiley Drake was the Vice Presidential candidate for America's Independent Party (AIP) who later joined Barnett v Obama lawsuit filed in 2009, but remember this suit wasn't filed until after the general election. Therefore, Drake's efforts were made after NOT before election day in 2008, the Electoral College certification and Congresses affirmative acceptance of the College's majority vote for Mr. Obama.

Third, McInnish-Goode are not suing the Alabama Democratic or Republican Party nor any of the presidential candidates. They are only requesting Ms. Chapman do her job as Secretary of State, that is to “verify the eligibility of all the candidates for the Office of President of the United States by requiring from each a bona fide birth certificate sent directly to her from the official in charge of the depository where such is held, and verifying that each is of the character and quality of that required for a teenager to receive a driver's learner's permit, before placing them on the 2012 general election ballot.” Chapman's attorney will be State Attorney General Luther Strange.

According to the Alabama State Attorney General's website, Strange is duty bound as a "constitutional officer whose duties and powers are prescribed in Title 36, Chapter 15, of the Code of Alabama (1975). As the state's attorney, he provides legal representation for the state of Alabama, its officers, departments, and agencies. The Attorney General defends the state in all lawsuits in which the state is named as a defendant. He represents the state in all court proceedings wherein the constitutionality of a state statute is challenged."

Fourth, this Civil Action is filed in the correct venue--the Circuit Court of Montgomery, Alabama. The Presiding Judge of the Circuit Court is Charles Price. Judge Price, you may recall, first ruled in favor and later against Judge Moore’s right to post the Ten Commandments in his courtroom. Following Judge Price’s final ruling against Moore, the John F. Kennedy Library and Museum honored him with their JFK award "for his devotion to the principles of the American Constitution." We will soon learn if his devotion carries over to Article II qualifications and the definitive definition of natural born Citizen - citizen parents, plural, born on American soil.

Lastly, this suit doesn’t ask the court to rule on the correct definition of natural born Citizen nor does it request a review of any criminal allegations. Plainly, the suit only asks the Alabama Secretary of State to do her job.

On January 5, 2012, Dean Haskins, Director of the former Birther Summit, wrote an article titled "Update on New Lawsuit Filed Against Hawaii Department of Health on Behalf of Virginia Sunahara's Brother, Duncan Sunahara." This week Article II Super PAC ran the above ad in the Washington Times Weekly and Daily to draw people's attention to Hawaii's Deputy Attorney General, Jill Nagamine, using, some suggest abusing, her power by blocking the Sunahara family from securing baby Virginia's original Hawai'ian long-form birth certificate and by extension ALL Hawai'an's original birth records. Why the State of Hawaii is fighting this extremely simple request spending thousands of taxpayer's funds is beyond our ability to even make a guess. Cancel the Presidential Debates: We Have Unvetted Candidates

On August 30, 2012, Article II Super PAC sent letters to all appointed Members of the Commission on Presidential Debates reminding them of their organization's mission and responsibility to the people of the United States. That is, no presidential candidate can take part in the upcoming debates without authenticating their Article II qualifications.

We know there is no state or federal agency responsible for vetting presidential/vice presidential candidates, but rather this extremely serious national security responsibility rests solely within the purview of the national political parties.

Therefore, Article II Super PAC along with countless of other citizens have requested from the Commission on Presidential Debates to "clarify its official position on this national security issue and explain how the CPD qualifies Presidential candidates' constitutional eligibility as natural born Citizens of the United States."

If there is nothing else we've learned these last four years it's that the political party system has created an impenetrable wall between themselves and the voting public. Israeli Expert Confirms Obama Birth Certificate is a Forgery

On Sunday, September 9, 2012, Obamareleaseyourrecords/BirtherReport blog posted a bombshell report titled "Israel Science And Technology Confirm Obama Birth Certificate Forged: Slams U.S. Congress." Because this Israeli agency and the author of the report, Israel Hanukoglu, Ph. D., are unknown to us, we asked Mara Zebest, Adobe Expert, to confirm Dr. Hanukoglu's conclusions. Here is what she had to say -

Yes... it's all true... I think there's a youtube posted on how the 1 disappears when magnified in viewing within certain programs. If memory serves correctly... the youtube video showing the disappearing text might have been using a google product... like Google Chrome or something along those lines. The digit or characters that disappear are all located on the bottom layer. The bottom layer contains the safety paper image and all the aliased (pixelated) characters. The bottom layer is the only 8-bit layer - multi-color layer...(if you remember my explanation of these layers and the challenge report I wrote).

All other layers are 1-bit (one color only)... so maybe these programs have trouble viewing 8-bit color information at a high magnification? The bottom layer also used a different exporting algorithm from the other layers... so maybe this algorithm result is interpreted differently in the Foxit program when viewed at high zoom levels. Not sure what the cause of the disappearing info could be... but apparently it does happen.

I do not have the two programs used and mentioned from this article (Foxit and Inkscape)... but the results are consistent with what I see in Illustrator. The article talks about the objects being "grouped" in Inkscape... which is the equivalent in Illustrator to the instruction I've written about in which the user needs to "Release Clipping Mask" - this ungroups and also reveals hidden information. The fact that there is a "clipping mask" that hides information is a definite manipulation process. NO process (such as optimization) will insert a clipping mask that HIDES information. To be clear... such a process might insert a clipping mask... but the clipping mask will NEVER HIDE information... it will only define the outside boundary of the image.

"Long-Form Birth Certificate of Obama is a Forged Document"

Since this is a site of Science and technology, there is a need to explain why this site dedicates a page to expose forgery about a document related to Mr. Barack Hussein Obama. Mr. Obama is the President of the USA that is currently the leader of the Free World, and the most powerful country in the Western hemisphere. Indeed, it is Ms. Jackson, that is echoing the demand by the People of ALL candidates being transparent about who they are.

Four years and running the American public has been steadily demanding to know whether Mr. Obama meets the three extremely simple qualifications outlined under Article II, Section 1 to even serve as President of the United States. Inquiries have been met with shallow 14th amendment arguments and/or a wall of silence.

RNC 2012 Platform Must Include Definitive Definition of NBC

Did you ever think you would see the day a national political party would actually have to be asked to include in their Party's Platform the definitive definition of a "natural born Citizen?"

The RNC 2012 Platform Committee has opened up their process to the voters by asking them for their "Ideas" on what they would like to see included in the 2012 strategic document. When you click on the category "Government Reform" and then click on the topic "Courts and the Constitution" you will see 104 "Ideas."

Out of the 104 "Ideas" posted under this topic area two deal directly with Presidential Qualifications, Article II. The best comment out of the two was one written by a poster named Ralyn S. Here is their "Idea" -

"Define 'natural born' as intended by common law and clearly defined in the Supreme Court ruling of Minor vs Hapersett, 1875. A natural born citizen is the offspring of 2 American citizens at the time of birth and born on American soil or to parents of citizens in service to our country if born overseas."

We too submitted the below "Idea" -

"A natural born citizen is one 'born in a country of parents who were its citizens' Minor v. Happersett, 88 U.S. 162 (1875). Our state or federal governments (not our political parties) should certify that every presidential nominee is a natural born Citizen before the nominee's name can be allowed on any state ballot."

Funny though, as in odd, strange, peculiar, Article II posted our submission yesterday afternoon around 4:00 pm EDT but it has yet to appear. The comment area appears to be frozen on 104 "Ideas" which is impossible; especially since one of the natural born Citizen submissions was blasted out in a Google Alert yesterday.

The few minutes you take to write a quick note may very well lead to persuading the RNC 2012 Platform Committee to adopt the Founding Father's definition of "natural born Citizen." We feel strongly that the GOP 2012 Platform Committee needs to hear from voters and who knows, it may lead to prompting an immediate congressional investigation into answering the question:

Speaking of Congress, Article II Super PAC has been running full-page ads in the Washington Times Daily and Weekly leading the call for an immediate congressional investigation into Sheriff Arpaio's Cold Case Posse findings. Why haven't the constitutional deniers addressed my latest challenge and documented how they can duplicate (through optimization) the object code layering seen in Obama's PDF file. They need to supply software and all settings involved, especially the optimization settings that produce the results seen in Obama's PDF file... by supplying the software and settings involved... we can all verify any proof presented—supposition doesn't count—that the PDF file is not a forged manufactured document.

The bottom line, documented in detail within the report, is that an optimized layer pattern will only contain a single layer of 1-bit quality that displays black only. All remaining layers (in an optimized file) are 8-bit—containing multiple colors. In other words, the optimization process pulls out all the black color onto a single (1-bit) layer—not two (1-bit) layers, not three (1-bit) layers, not eight (1-bit) layers—just one layer with this 1-bit ImageMask true object code attribute. Obama’s PDF file (as seen in the figure) contains EIGHT 1-bit layers—all of which fail to reflect a black color.

Should Anwar al-Awlaki have been eligible to run for President?

Anwar al-Awlaki was born in 1971 to Yemeni citizens in Las Cruces, New Mexico. US Intelligence reports that, from the age of seven, al-Awlaki was raised abroad, becoming an enemy of America, indoctrinated by the highest powers of Al-Qaida and studying under the same teachers as Osama bin Laden. He eventually influenced various terrorists such as the Fort Hood shooter, Nidal Malik Hasan, and helped plan the thwarted attack of the "Underwear Bomber," Umar Farouk Abdulmutallab. Al-Awlaki's phone number was found among the contact information of Ramzi bin al-Shibh, the man known as "the 20th hijacker" in the 9/11 attacks.

Those who suggest that there is no distinction between "citizen" and "Natural Born Citizen" would have us believe and accept that such a person might have been eligible to run for President of the US simply because he was born in America. According to defenders of the alleged eligibility of Barack Obama (or Marco Rubio, or Bobby Jindal), any person born on US soil to one or more alien citizens could be the leader of the free world. At some point, according to that path of logic, this should have included Anwar al-Awlaki.

So, to say that every child born in America is a natural born citizen is also to say that any foreign interest whose child was born in the US could be allowed to raise that child abroad as an enemy of the US and return that child to this country in time to meet the Constitution's 14-year residency requirement for President.

Considering that Islam has been at war with itself and the rest of the world at least since the death of Muhammad almost 1400 years ago, it takes very little imagination to project how a powerful enemy of the US might take the necessary 35 years and other resources to groom a "Manchurian Candidate" for the US Presidency. If we accept the premise that every person born in the US is a natural born citizen, we allow the establishment of a flawed precedent permitting a family such as that of Anwar al-Awlaki (or a communist government, or a Mexican drug cartel, etc.) to gain control of our country through an orchestrated, long-term attack on the Presidency.

This is precisely what the Framers were trying to prevent with the natural born citizen requirement. A note from John Jay to George Washington explains to us why the Framer's included the natural born citizen requirement for POTUS. It was not, as some would have us believe, to discriminate against any particular race or to keep white men in power. Jay stated outright that the goal was "to provide a strong check to the admission of Foreigners into the administration of our national Government." This is not a proscription against any ethnic heritage. It was the Framer's best effort, within the framework of a free society, to restrict the trust of our highest office only to persons with the greatest likelihood of being reared with an abiding love of American values.

The Constitution itself argues against the assertion that every child born in America is also a natural born citizen. Constitutional eligibility requirements for members of the House and Senate include that they be "citizens," with progressively tighter restrictions on length of residency for Senators and the President. Following that same pattern of progressively increased restrictions, the Constitution also requires that the President must be, not just a citizen, but a "natural born Citizen."

The natural born citizen requirement is not an incidental flourish of language, but a national security provision of the supreme law of our land. It is not a "big tent" invitation but an intentionally restrictive, but not racist, prohibition. It serves as a foundation on which to permanently secure and preserve the rights and freedoms which are the heritage of all Americans. Its purpose is to ensure, to the greatest possible extent, that every American President has sole allegiance to the USA by virtue of a childhood steeped in the richness of American culture, anchored in a respect for freedom, emboldened by the spirit of independence and innovation, and committed to the continuation of the noble experiment of a republic created and protected by free men and women and their progeny.

Since learning on July 17, 2012 that Barack H. Obama’s long-form birth certificate PDF image posted on the White House website on April 27, 2011 is a forgery, the majority of the American public has been dumbfounded. The very idea is unfathomable, but it's now a fact.

Who developed the forged PDF image—remains unknown. Was Obama aware the long-form birth certificate was a forgery prior to it going public—remains unknown. Is the PDF image of the long-form birth certificate the same one Obama’s attorney's retrieved from the Department of Health in Hawaii the day before the White House posted it—remains unknown. Finally, why did someone in the White House post a long-form birth certificate PDF image that is a forgery to begin with?

Houston, We the People have a problem.

As lead investigator Mike Zullo of the Maricopa County Cold Case Posse, the law enforcement team that investigated the long-form birth certificate and determined it to be a forgery, stated during the July 17 press conference “It is time for this charade to stop!”

. This article contains an ongoing debate with Obama’s defenders and provides great insight into the question of whether Obama is a “natural born Citizen.”

First, we maintain that “Obama has presented no evidence to the State of New Jersey proving his identity, place of birth, or parentage. Not providing any such evidence, he has not established that he is an Article II “natural born Citizen.” Remember that Obama in open court and on the record conceded, through his attorneys which the Administrative Law Judge confirmed, that he has provided the State of New Jersey not one iota of evidence as to who he is, where he was born, or who is parents are. This includes Obama’s concession on the record that the internet image of an April 2011 alleged long-form birth certificate from Hawaii is not evidence and not to be considered by the New Jersey court in making its decision on the question of whether the Secretary of State should allow Obama’s name to be placed on the election ballots in New Jersey.

In this connection, read this July 6, 2012 article published in Canada Free Press by private investigator, Doug Hagmann, entitled Obama’s Legal Identity Problem, accessed at

Investigator Hagmann, with many years of private investigation experience and with all the investigation tools at his disposal, comments on private investigator Susan Daniels’ recently filled suit in Ohio in which she alleges that Obama has not established his true identity to be entitled to be placed on the Ohio election ballot for president, focusing in on his fraudulent social security number. Investigator Hagmann explains how social security numbers are obtained and that based on his investigation, he agrees with Susan Daniels’ findings and he himself concludes not only that Obama’s social security number is probably fraudulent but that he

“could only reach one conclusion with the highest degree of certainty: the man known as Barack Hussein Obama II would FAIL in all aspects relating to his true identity.”

These conclusions, reached by two professional private investigators, support our position that Obama HAS NOT CONCLUSIVELY ESTABLISHED that he is eligible to be elected President.

Second, even if Obama were to provide to the State of New Jersey evidence of his identity, place of birth, and parentage, and that evidence were to confirm his identity, place of birth, and parentage to be as he has publicly represented them to be, he still is not eligible to be elected President. He was born to a father who was never a “citizen” of the United States. His father was a citizen of Great Britain and Kenya. Not being born to two U.S. “citizen” parents and inheriting the allegiance and citizenship of his alien father (both that of Great Britain and Kenya), he was born with dual and divided allegiance and a subject to a foreign power. He was not born within the full and complete civil, political, and military allegiance and jurisdiction of the United States. He, therefore, cannot be an Article II “natural born Citizen,” and constitutionally entrusted to command the singular and all-powerful offices of the President and Commander in Chief of the Military. This means that Obama CANNOT ESTABLISH that he is constitutionally eligible to be elected President.

in a country of parents who were its citizens

became themselves, upon their birth . . . natural-born citizens”).

Obama’s attorneys will soon be filing their opposition to this filing in the NJ Supreme Court. I will then be filing my reply. The NJ Supreme Court will then decide whether it will accept this case for review. If it accepts to review the case, the Court will then ultimately decide the case, possibly with more briefs and with or without oral arguments. Regardless of how the case ends in New Jersey, it is safe to say that the case will then be filed for review in the U.S. Supreme Court.

One can only imagine the amount of time and effort that is needed to litigate a case like this through our state courts and all the way to our U.S. Supreme Court. Such litigation generates significant expenses, not to mention the great amount of time that the attorneys have to spend on the matter. We are therefore requesting that you consider making a generous donation to the New Jersey ballot access challenge case so that we can continue to pursue this most critical issue to our republic through our courts and eventually to Congress, if necessary.

Obama's 'missing year' at Columbia found?

NEW YORK – Two separate database reports from the National Student Clearinghouse have contradicted President Obama’s claim he attended Columbia University for two years. The reports have added to the intrigue generated by Obama’s unwillingness to discuss his time at the Ivy League institution, his refusal to release educational records, and the fact that many political science students and faculty there in the early 1980s say they don’t remember him.

Swirling amid the black hole of information are a host of theories about Obama’s whereabouts – particularly during the 1981-1982 school year – including speculation he was working for the CIA in Pakistan.

Now, the clearinghouse, with permission from Columbia, has decided to make an exception to its media policy and address WND’s inquiry into the discrepancy. Why do clearinghouse records indicate Obama was at the school only during the 1982-83 school year while Obama and Columbia’s spokesman have insisted he began attending the New York City school in the fall of 1981?

Janine Greenwood, vice president and general counsel for the clearinghouse, told WND there was a “computer error” in their system that has been corrected. She said she confirmed with Columbia that Obama was at the university for two academic years, not one.

Dear Mr. Romney:

            Between now and the start of the August 27^th Republic National Convention you and your team will be deliberating who your Vice Presidential running mate will be. Obviously, this will be an important and momentous decision for you, your running-mate, and for our country. Your selection however will receive an incredible amount of scrutiny from a growing legion of constitutionalists who believe that adherence to the Constitution, i.e., the supreme law of the land is paramount above all else. Your choice for a running mate MUST comply with requirements mandated by Article 2, Section 1 and the 12^th amendment of the U.S. Constitution. Nothing less will be acceptable.

            You are no doubt fully aware that two of the favored choices for vice-president, bandied about by the left-leaning media and heartily endorsed by the republican political establishment, Marco Rubio and Bobby Jindal, are in fact constitutionally ineligible to be vice-president and/or president. Simply stated they are not “natural born Citizens” as required by law. Given the controversy of your father’s presidential candidacy in the sixties as it pertained to his citizenship status, and of course the ever-growing controversy surrounding the identity of the current resident in the White House, we are confident that you are intimately knowledgeable of this issue.             Neither Governor Bobby Jindal, nor U.S. Senator Marco Rubio’s nativity conform to the American citizenship requirement of “natural born Citizen” outlined under Article II, Section 1 of the U.S. Constitution. Americans, a majority of which are independent conservative voters, know the definitive definition of “natural born Citizen” as being born to citizen parents on American soil. It matters not one iota what the political class pontificates on high as it relates to this most basic of citizenship definitions, a category of citizenry that has been defined for millennia.

            Recently, Brett Baier of Fox News dipped his toe into this raging debate and proffered a nonsensical “natural born Citizen” definition of which Article II Super PAC invited Herb Titus, Esq., a constitutional attorney who has over thirty-years of writing, advocating and lecturing on constitutional law responded –

           “Bret Baer commits a common error. He assumes that "natural born citizen" means the same thing as "citizen by birth." They are not the same. A citizen by birth is one who by constitutional or statutory provision is made or recognized as a citizen based upon where or to whom he was born.   Under Mr. Baer's view, a natural born citizen, then, is a citizen of a particular nation only by positive law. If a natural born citizen is defined by statute, as Mr. Baer claims he is, then by statute Congress can take away his natural born citizenship status, subject only to the 14th Amendment's definition of citizenship by birth. And even that citizenship can be taken away by an amendment to the constitution.  Indeed, according to Mr. Baer, no one could have been eligible to be elected president UNLESS Congress passed a statute designating one's citizenship by birth, or until the 14th amendment definition of citizenship by birth was ratified.”

          “A natural born citizen, by contrast, is not dependent upon Congress passing a statute or the constitution being amended. A natural born citizen is a citizen of a specific nation by the law of nature of citizenship.  The law of nature of national citizenship is written into the very nature of the universe of nation-states, and is universal as to place, uniform as to person, and fixed as to time. By definition the law governing natural born citizenship exists independent of any human power, legislative or otherwise. That is why "natural born citizenship" is not defined in the Constitution.  Such citizenship exists whether recognized by positive law or not.  Such citizenship is God-given. To qualify one must be born to a father and a mother each of whom is a citizen of a particular state in order for the person to be "natural born" citizen of that state.”(emphasis added)

            Here are the facts. Governor Bobby Jindal’s parents did not apply for any form of American citizenship until after Jindal was born on June 10, 1971, in Baton Rouge, Louisiana. Amar Jindal, the Governor’s father, did not secure American citizenship until December 4, 1986, and his mother, Raj Jindal, did not acquire her American citizenship until September 21, 1976. Thus, Governor Bobby Jindal does not and never could meet the “natural born Citizen” requirement outlined under Article II of the U.S. Constitution.

            As well, U.S. Senator Marco Rubio’s citizenship also lacks the necessary pillars of “natural born Citizen”. Neither of the Senator’s parents applied for citizenship status until November 1975; a full four years after the Senator was born on May 28, 1971, in Miami, Florida. Therefore, U.S. Senator Marco Rubio does not and never will meet the three remarkably simple qualifications outlined under Article II, Section 1 of the U.S. Constitution.

            American citizens have endured a four-year constitutional battle with the media establishment and the political class of this nation over the meaning of “natural born Citizen” due to Barack Hussein Obama and his “dual-citizenship” status. As you know, Obama’s father, Barack Obama, Sr., never claimed citizenship in America, but rather held citizenship as a British born subject under the 1948 British Nationality Act. His mother, Stanley Ann Dunham, was born a citizen of the United States, clearly rendering Mr. Obama a “dual citizen” not a “natural born Citizen” at birth. Nowhere in any law or Supreme Court precedent has anyone ever made the argument that “dual citizenship” equates with “natural born citizenship”. Yet for some peculiar reason, the political class seems to believe the American electorate can be fooled by their rather amateurish obfuscation on the precise definition of “natural born Citizen” by attempting to rewrite thousands of years of settled law.

            Therefore, Article II Super PAC respectfully requests you honor the U.S. Constitution and remain within the confines of Article II, Section 1 when making your final selection for a Vice Presidential running mate.

The Voeltz v Obama case is finally getting its first day in court Monday, June 18. Like all such cases, it challenges the right of the man who calls himself “Barack Hussein Obama” to be on the state ballot, because he hasn’t established that he is a natural born Citizen. The U.S. Constitution and Florida law require that, although they don’t specify how that is to be verified. To make it even more problematic, natural born Citizen isn’t defined in the constitutional requirement, so it is necessary to delve into statutory and settled law, even into the words of the founders, to do so. I’ll try to summarize the what, who and why of the case.
Voeltz v Obama Goes to Court!

Monday’s event is just to hear a motion for dismissal and debate the nature of the “natural born Citizen” requirement for the Presidency. Win or lose, it will likely be appealed and will drag out much dirty laundry for the public to hear, see and smell. He won’t be able to get elected dogcatcher, when we’re done with him, compliant media notwithstanding.

The Best Letter to the Editor this Week

The establishment is putting a lot of effort into deceiving the public. This past Sunday’s edition of the Johnson City Press included a column by Byron York, the chief political correspondent for The Washington Examiner, and obvious stooge for the establishment.

In his column, York disparages “birthers” as ignorant of the law regarding who is, and who is not a “natural-born citizen.”

York states, “The Constitution specifies that a president must be a ‘natural- born citizen’ of the United States, but it does not define the term. The Supreme Court has never clarified the issue.”

York is mistaken.

In the 1875 Supreme Court case of Minor v. Happersett, a case on women’s suffrage, the subject of citizenship was addressed in the Court’s majority opinion, and the term, “natural-born citizen” was defined. The Court wrote: “At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or natural-born citizens.”

Supreme Court Should Review Liberty Legal Foundation's Georgia Eligibility Case

Later this month Liberty Legal Foundation will be filing its petition for the U.S. Supreme Court to overturn the Georgia Supreme Court’s ruling that Obama is a natural born citizen. As you know, Liberty Legal Foundation represented David Welden, one of the plaintiffs in the Georgia ballot challenges, earlier this year. Our efforts resulted in the first court ruling to reach the merits of an Article II challenge against Obama. All previous courts had dismissed such challenges on procedural grounds.

The Georgia Administrative Court and the Georgia Secretary of State both erroneously ruled that Obama is a natural born citizen because any person born on U.S. soil is, according to them, a natural born citizen. The Georgia Administrative Court was the first court to make such a ruling and have the authority to do so. Of course the ruling was wrong, but that is what we will be arguing to the Supreme Court.

In order to get there, we must show the Supreme Court that we have a case that allows the Court to reach the substantive issue. Please understand what I’m saying here because it is historic and critical to this entire eligibility fight. So, let me say it again: Never before had any court, anywhere in America, had authority to rule on whether Obama is an Article II natural born citizen, and actually made a ruling on the substance of that issue. Every other court had either dismissed on procedural grounds or ruled without authority to do so. This is why this issue has not previously reached the U.S. Supreme Court on the substance of the issue.

Many reading this will point to an Indiana Appellate Court decision from 2009, claiming that the Indiana Court had decided this issue. It is true that the Indiana state court ruled in Arkeny v. Governor that Obama was an Article II natural born citizen. In fact the Georgia Administrative Court relied on Arkeny, claiming that the Indiana Court had decided this issue. However, the Indiana Court’s own opinion admits that it didn’t have jurisdiction. Therefore the Arkeny Court had no authority to decide the Article II issue. The fact that it ruled on the issue, after admitting that it had no authority, simply proves that that court was yet another activist court full of judges willing to reach beyond the authority that we’ve given them.

You see, the Arkeny Court ruled that the plaintiff challenging Obama in Indiana didn’t have standing. When a plaintiff lacks standing, the court lacks jurisdiction. Which means that the court has no authority to decide the substantive issue of the case, even if it wants to do so. The Arkeny Court admitted that it lacked standing, and then it ruled on the substantive issue anyway. The judges in that case should be ashamed of themselves. Their ruling reflects either judicial activism at its worst, or inexcusable incompetence.

This is one of those articles that needs to go viral. Doug Ross@Journal delved deeper into Obama's literary agent story, using the Wayback Machine, and discovered his bio was edited several times over the 17 year period in question. These edits reflected milestones so to speak on Obama's resume, but interestingly his place of birth, Kenya, was not altered, that is until sometime between April 3rd and April 21, 2007. h/t TexasVoter

Barack Obama's biographical brief edited repeatedly over 17 years, but Kenyan birthplace changed just weeks after his presidential run announced

The biography provided by Barack Obama to his literary agent specified his birthplace as "Kenya". And, over the course of 17 years, despite multiple revisions by Obama, the Kenyan birthplace remained a fundamental part of the bio on the agent's website.

I've used the Wayback Archive to explore the exact transformations of Obama's biography on his agent's site (click on any of the thumbnails to zoom to a readable size)(Thumbnails are on the original article with a link posted below).

On June 27, 1998, the website read: "BARACK OBAMA was the first black president of the Harvard Law Review. He was born in Kenya to an American anthropologist and a Kenyan finance minister, and was raised in Indonesia, Hawaii, and Chicago. His first book is DREAMS FROM MY FATHER: A STORY OF RACE AND INHERITANCE."

The Obama entry remained unmodified (e.g., June 6, 2002) until sometime around December 9, 2004, when it was modified to read: "BARACK OBAMA is the junior Democratic senator from Illinois, and was the dynamic keynote speaker at the 2004 Democratic National Convention. He was also the first African-American president of the Harvard Law Review. He was born in Kenya to an American anthropologist and a Kenyan finance minister, and was raised in Indonesia, Hawaii, and Chicago. His first book, DREAMS FROM MY FATHER: A STORY OF RACE AND INHERITANCE, is a New York Times bestseller."

On February 10, 2007, Senator Barack Obama formally announced his candidacy for the Presidency.

Herbert W. Titus is of counsel to the law firm of William J. Olson, P.C. Prior to his association with this firm, Mr. Titus taught constitutional law, common law, and other subjects for nearly 30 years at five different American Bar Association approved law schools. From 1986 to 1993, he served as the founding Dean of the College of Law and Government in Regent University, Virginia Beach, Virginia. Prior to his academic career, he served as a Trial Attorney and a Special Assistant United States Attorney with the United States Department of Justice in Washington, D.C. and Kansas City, Missouri. Today he is engaged in a general practice with a concentration in constitutional strategy, litigation, and appeals.

His constitutional practice has taken him into federal district courts in Alabama, Arizona, Georgia, Montana, North Carolina, Oklahoma, Oregon, Texas, Wyoming, and the District of Columbia and the state courts of Idaho, Texas and North Dakota.

He serves as general counsel to the Michael New Action Fund. He also does research and legal writing for the Free Speech Coalition and other similar organizations dedicated to the restoration of constitutional law and liberty in the nation.

Mr. Titus has appeared as a guest on radio and television shows and, for two years, hosted his own daily radio program, That's The Law, on the VCY America network. He has testified on constitutional issues before the United States Congress. He has also testified on state and federal constitutional issues before several state legislatures. His views on constitutional law have received wide circulation on the Internet and other media, and among members of Congress, state legislatures, and public policy advocates and organizations.

Mr. Titus has written numerous articles, book chapters and constitutional studies and analyses. He is the author of God, Man & Law: The Biblical Principle, a widely acclaimed text on American common law. His e-books on the common law and constitutional liberty (co-authored with Gerald Thompson) are available at www.lonang.com. Mr. Titus is regularly invited to lecture and conduct workshops on American legal and constitutional history before civic groups, church gatherings, and homeschool conferences.

Mr. Titus and his wife, Marilyn, have been married 48 years and reside in Chesapeake, Virginia. The Tituses have four children and 15 grandchildren.
